Ebuno AB, a Swedish company with company organization number 559183-6027 (“Ebuno”, “we”, “our” or “us”), is responsible for the processing of your personal data as described below. This privacy policy concern you who register an account and become an Ebuno user.

We care about and value your privacy. Through this privacy policy we therefore wish to provide you with information on how we process your personal data as well as what rights you have in relation to our processing of your personal data.

From where do we collect your personal data and are you required to provide personal data to us?

We collect your personal data directly from you, for example when you register an account and answer our profiling questions.

In some of our profiling questions you can choose to share sensitive personal data (e.g. data about your health) with us. Answering these questions is optional and we will process the data you share with us only if you give your explicit consent .  

Generally, you are free to choose if you want to provide your personal data to us. It is however in some instances necessary for you to provide personal data to us, e.g. to register an account. What exact personal data we require from you can be found in the tables below in relation to the legal bases “fulfilment of contract” and “legal obligation”. The data we require from you is never sensitive data.

If you don’t provide us with certain requested personal data, you will not be able to participate in the surveys or games we provide or create and use an account. Furthermore, we will not be able to comply with bookkeeping and accounting law and handle possible legal claims.  

Who can gain access to your personal data and why?

Your personal data is primarily processed by us at Ebuno. However, in certain instances, we share your personal data with third parties in accordance with below.

No matter the purpose for our processing of your personal data, we will share your personal data with our IT-suppliers who will process these on our behalf and on our instructions in order to ensure good and secure IT-operations. We only share your personal data with our IT-suppliers if it is necessary in order for them to fulfil their obligations towards us according to the contract that we have with them.

If you participate in surveys

Where are your personal data processed?

We, as well as our processors, mainly process your personal data within EU/EEA. When we process your personal data outside of the EU/EEA we do so because our partner, which help us match your profile to surveys you find interesting and relevant, will store your personal data outside of the EU/EEA.

When we transfer your personal data outside of the EU/EEA, we do so based on either a decision from the Commission, standard contractual clauses or Privacy Shield.

What rights do you have in relation to our processing of your personal data?

According to applicable data protection legislation, depending on the circumstances, you are entitled to a number of different rights which are set out below.

Right to information and access

You have the right to obtain a confirmation on whether we process your personal data. If we process your personal data, you also have a right to receive information about how we process the personal data and to receive a copy of your personal data.

Right to rectification

You have a right to have inaccurate personal data corrected and to have incomplete personal data completed.

Right to erasure (“right to be forgotten”) and restriction of processing

You have the right to have your personal data erased in certain instances. This is the case e.g. when the personal data is no longer necessary for the purposes for which it was collected or otherwise processed and where we process your personal data on the basis of our legitimate interest and we find, following your objection (see below under Right to object), that we do not have an overriding interest in continuing to process it.

You also have a right to request that we restrict our processing of your personal data. For example, when you question the accuracy of the personal data, when you have objected to our processing of your personal data based upon our legitimate interest, or where the processing is unlawful, and you oppose to the erasure of your personal data and instead want us to restrict our processing.

Right to data portability

In certain instances, you have a right to be provided with such personal data (concerning you) that you have provided to us, in a structured, commonly used and machine-readable format. You also have a right to in certain instances have such personal data transferred to another controller, where technically feasible.

Right to object

You have the right to object to our processing of your personal data if we use it for marketing purposes.

You also have a right to object to our processing of your personal data when the processing is based on the legal basis “legitimate interest”. The situations when we base our processing on our legitimate interest are stated in the below charts and you can read more about our balancing of interest assessments in the end of this privacy policy. In some instances, we may continue to process your personal data even if you have objected to our processing. This can be the case if we can show compelling legitimate reasons for the processing that outweigh your interests or if it is for the purpose of establishing, exercising or defending against legal claims.

Right to withdraw consent

You have the right to withdraw a given consent at any time. The withdrawal will not affect the lawfulness of processing based on your consent before the withdrawal.

Right to lodge a complaint to a supervisory authority

You have the right to lodge a complaint to a supervisory authority concerning our processing of your personal data.

Such a complaint can be filed with the authority in the EU/EEA member state where you live, work or where the alleged infringement of applicable data protection legislation has occurred. In Sweden, the supervisory authority is The Swedish Data Protection Authority.

Legitimate interest

It is not necessary for you to provide us information about your street address and phone number to fulfil any contract. This information is instead processed on the basis of our legitimate interest to process your personal data in order to administer your account.

Legitimate interest

Our legitimate interest to process your personal data to reward you with the extra points for recruiting one of your friends to Ebuno.

If you are the referred friend and register an account, we will process your personal data based on the performance of contract, please see above.

Storage period: We will store your personal data until you choose to delete your account at Ebuno or until you have been inactive for 3 years.

Note that it is optional to answer these questions and that you choose what information you want to share with us.

Information you provide to us, e.g.:

  • Information about your household, education and occupation, car, food and beverages, hobbies and interests, electronics, computer and video gaming, media, travel and what research surveys you are willing to participate in
  • Information about your ethnicity, smoking and tobacco habits, healthcare and eventual children

Legitimate interest

Our legitimate interest to process your personal data that you choose to give us to be able to create and administer your profile.

Explicit consent

Sensitive information will be processed based on your explicit consent. You can withdraw such consent at any time. You can also change some of the answers you have given to “I prefer not to declare this”.

Storage period: We will store your personal data until you choose to delete your account, until you have been inactive for 3 years or until you change your answers to “I prefer not to declare this”. We will stop storing your sensitive personal data immediately if you withdraw your consent.

Storage period: We will process your personal data until the matching is done. We will stop storing your sensitive personal data immediately when you withdraw your consent or change your answers to “I prefer not to declare this”.

To provide surveys

Note that we provide the opportunity for you to participate in surveys, but the actual surveys are managed by third parties. If you choose to state your name or any other information about yourself in a survey, the survey company might be able to tie your answers to you as a person. In such cases, the survey company will become a controller. If you want to know more about how they process your data you can contact the relevant company.

Storage period: Your personal data will be removed if you ask us to remove it or if you yourself delete the content, but we will otherwise store the personal data on the social media platform until further notice.

Balancing of interests assessments

As we state above, for some purposes, we process your personal data based upon our “legitimate interest”. By carrying out a balancing of interests assessment concerning our processing of your personal data, we have concluded that our legitimate interest for the processing outweighs your interests or rights which require the protection of your personal data.

Terms and Conditions for Panel Membership, Survey Participation and Use of Services

Definitions

When used in these Terms, the following terms and expressions shall have the following meanings.

Active Panelist” refers to a Panel Member that has: (a) participated in a Survey, (b) other Research Program; or (c) other parts of the Service, at least, once over the last twelve (12) months; or (d) updated his/her profile or member information at least once in the last twelve (12) months.

Market Research Tracking Service” refers to a Service accepted by a User that may track online behavior of such User, such as websites accessed by the User and online campaigns exposed to the User for market research purposes, including advertising tracking research.

Applicable Law” refers to applicable national and/or local laws and regulations.

Client” refers to Our clients to whom We provide services.

Content” refers to the information on Our Site, a Survey Site, a Panel Site or a Partner Site.

Panel” refers to a group of individuals who have agreed to be invited to and participate in market research Surveys, other Research Programs or other parts of the Services for market research.

Panel Member” refers to a member of a Panel.

Panel Owner” refers to the owner of a Panel and a Panel Site that You are a Panel Member of.

Panel Site” refers to a website where individuals can register to become Panel Members.

Partner” refers to one of Our partners, including Panel Owners and other partners.

Partner Site” refers to a website that is operated by one of our Partners.

Participant” refers to an individual, who is not a Panel Member, directed to a Survey, other Research Program or other parts of the Services by one of Our Partners.

Personal Data” means any information relating to an identified or identifiable natural person (“Data Subject”); an identifiable natural person is one who can be identified or traced, directly or indirectly, in particular by reference to an identifier either alone or when combined with other personal or identifying information. Personal Data can include information such as name, social security number, date and place of birth, mother‘s maiden name, biometric records, photographs, sound or video recording, and other information that is linked or linkable to an individual, such as medical, educational, financial, and employment information. (NOTE: Personal Data may also be referred to as Personally Identifiable Information or PII.)

Research Program” refers to research opportunity other than a Survey.

Restricted Content” refers to confidential and/or proprietary information, materials, products, and Content belonging to Us and/or a Panel Owner, a Survey Owner, a Client, a Partner and/or a licensor.

Service” refers to the service provided by Us that permits You, as a Panel Member or a Participant, to participate in (a) a Panel or a Survey, (b) other research program, or (c) any other service provided by Us and used by You, such as a Market Research Tracking Service.

Submissions” refers to all comments, feedback, suggestions, ideas and other information that You submit or We collect when You participate in a Panel, respond to a Survey or other Research Program or use a Service.

Survey Owner” refers to the owner of a Survey, which typically is a Client.

Survey Site” refers to the website where You respond to and complete a Survey.

Surveys” refers to market research surveys made available by Us to You.

Third Party Websites” refers to websites maintained and/or operated by third parties.

User” refers to You as an individual when You use the Service.

User Content” refers to all content, materials, information, and comments You use, upload, post or submit or We collect when You use the Service, including information received through Ad Tracking Service, such as Internet usage pattern data.

You“, “Yourself“, “Your” and “Yours” refer to you as an individual.

We“, “Us“, “Our” and “Cint” refer to the Swedish entity Cint AB reg. no. 556559-8769.

1. Applicability; Agreement

These Terms and Conditions (hereinafter the “Terms”) apply in addition to any agreement with Panel Owner of the Panel of which you are a Panel Member, as well as any specific terms, which may apply for a Survey, other Research Program or other Service. These Terms shall not apply to the extent they are in conflict with the terms of an agreement between You and a Panel Owner or with specific terms provided by the Panel Owner or Client as a condition for Your participation in a Survey or other Research Program, provided, however, that such other terms shall not reduce Our rights or increase Our liability specified in these Terms.

2. Introduction

The purpose of these Terms is to set out the general terms and conditions for Your use of the Services, including Your participation in Surveys, Panel or other Research Programs.

We manage the relationship between a Survey Owner and a Panel Owner and We act on behalf of a Panel Owner. We are also the platform supplier, providing opportunities for Panel Members, to participate in Surveys, other Research Programs and use other services.

In addition to the above, We may also manage incentives. Details regarding such incentive scheme can be found in these Terms.

3. Panel Membership Eligibility

Panel membership is generally open to individuals who satisfy the requirements for membership, including, but not limited to, minimum age requirements and geographic location requirements. The requirements for Panel membership may vary by specific Panel and are determined by a Panel Owner. By agreeing to become a Panel Member, You agree to receive invitations to participate in Surveys, Research Programs or other Services, both from the Panel Owner you have applied to Panel membership for and from other Panel Owners. You may unsubscribe from Panel membership at any time, please see Section 12 “Opt-Out Policy” below.

We only allow one Panel Member per unique email address within each Panel.

4. Panel Registration

In order to become a Panel Member, You must register with a Panel Site and provide certain information about Yourself. The information You provide must be true, correct and complete. We reserve the right to restrict or prohibit Your access to the Service or participation in a Survey or other Research Program if You provide information, or We have reason to suspect that the information You have provided is not true, correct and complete.

A Panel membership is personal and may only be used by the individual who registers for membership with a Panel. You are responsible for keeping any user information and password confidential and You are responsible for any use, whether authorized or unauthorized, of Your membership account.

5. Conditions for Participation in a Survey, Other Research Program or Other Services

When You participate in a Survey, other Research Program or other Service, and/or use Our Site, a Survey Site or a Panel Site, You are obligated to comply with these Terms, as well as any other terms and conditions that apply to Your participation, including any agreement between You and a Panel Owner or terms applied by a Client or a Partner.

By participating in a Survey, other Research Program or other Service, You agree to provide true, correct and complete information about Yourself. If You provide information, or We have reason to suspect that the information You have provided is not true, correct and complete, You may not qualify for a Survey, other Research Program or other Service and consequently will not receive any incentives for Your participation. Furthermore, a Panel Owner may terminate Your membership with the result that You will not be able to participate in any more Surveys or other Research Programs.

You are responsible for actions and communications undertaken or transmitted from Your account.

6. Use of the Services

Participation in a Survey, other Research Service or use of other Service is voluntary. The Services are for personal, and non-commercial, use and We reserve the right to change, modify, restrict or block access to, all or any part of the Services, without prior notice.

We may at any time refuse to provide the Services to anyone at Our own discretion.

You acknowledge that You are accessing, using, and/or participating in the Services in the capacity of an independent contractor, and no agency, partnership, joint-venture, employee-employer or franchisor-franchisee relationship is intended or created by these Terms.

7. Unauthorized Use

You agree not to:

(a) disrupt, interfere with the security of or otherwise abuse the Service or Our Site, a Survey Site, a Panel Site, a Partner Site, or any services, system resources, accounts, servers or networks connected to or accessible through a Survey or a Survey Site or affiliated or linked sites;

(b) use spiders, robots or other automated data mining techniques to catalog, download, store, or otherwise reproduce or distribute data or content available in connection with the Service, or in other ways manipulate the result of a Survey;

(c) take any action to interfere with Our Site, a Survey Site, a Panel Site, or a Partner Site or an individual’s use of such sites, including, but not limited to, overloading, or “crashing” a website;

(d) send or transmit any viruses, corrupted data, or any other harmful, disruptive, or destructive code, file, or information, including, but not limited to, spyware, malware and trojans;

(e) collect any Personal Data of other Users of the Services;

(f) send unsolicited emails, such as promotions and advertisements for products or services;

(g) open, use, or maintain more than one (1) membership account with a Panel;

(h) use or attempt to use another User’s account, without authorization, or create an account with a false identity;

(i) attempt to obtain unauthorized access to Our Site, a Survey, a Survey Site, a Panel Site, a Partner Site or parts of a Survey, Our Site, a Survey Site, a Panel Site or a Partner Site that are restricted from general access;

(j) forge or mask Your true identity;

(k) frame a portion(s) of Our Site, a Survey Site, a Panel Site or a Partner Site and display it on another website or media or alter the appearance of any Survey Site, Panel Site, or Partner Site;

(l) establish links from a website to Our Site, a Survey Site, a Panel Site or a Partner Site or to the Services, without Our prior written consent;

(m) post or transmit any threatening, libelous, defamatory, obscene, pornographic, lewd, scandalous, or inflammatory material or content;

(n) use any foul; abusive or obscene language on Our Site, in a Survey or on a Survey Site, a Panel Site or a Partner Site;

(o) engage in any fraudulent activity, including, but not limited to, speeding through Surveys, taking the same Survey more than once, submitting false information during the registration process, submitting false or untrue Survey data, redeeming or attempting to redeem incentives through false or fraudulent means, tampering with Surveys and, with respect to the use of the Ad Tracking Service, accessing websites or online campaigns with the sole intention to provide a misrepresentative impression of Your online behavior;

(p) reverse engineer any aspect of a Service or take any acts that might reveal or disclose the source code, or bypass or circumvent measures or controls utilized to prohibit, restrict or limit access to any webpage, content or codes, except as expressly permitted by Applicable Law;

(q) engage in any criminal or illegal act(s) which may be linked to Our Site, a Survey or a Survey Site, a Panel Site or a Partner Site;

(r) use Restricted Content in violation or breach of these Terms; or

(s) encourage and/or advise any individual, including, but not limited to, Panel Members, Participants or any of Our employees, to commit an act in conflict with the Terms.

8. Restricted Content

Unless otherwise noted, all materials, including, without limitation, all concepts, text, designs, graphics, drawings, photographs, video clips, music and sounds, and all trademarks, service marks and trade names used in a Survey, other Research Program or other Service and/or on Our site, a Survey Site, a Panel Site or a Partner Site and the selection and arrangements thereof, are subject to intellectual property rights, including but not limited to copyrights, trademarks and patents or the right to apply for their registration anywhere in the world, held by or licensed by Us, a Survey Owner, a Panel Owner, a Partner, or other third parties who are the respective owner of, or controls, such Restricted Content.

When You use a Service or participate in a Survey, other Research Program or other Service, You may be exposed to Restricted Content. You are not granted any rights to the Restricted Content and all intellectual property rights are expressly reserved. No license to use, reveal, download, copy, distribute, or reproduce (including but not limited to posting to any website, social media or blog) the Restricted Content or the subject matter of the Restricted Content is granted to You. Please be advised that legal action may be taken in the event any unauthorized use of the Restricted Content is traced back to You. You are hereby informed and acknowledge that We will fully cooperate with all third party requests for disclosures (including but not limited to the disclosure of Your identity) related to claims that You have used Restricted Content in violation of these Terms which We deem are legitimate.

You may only participate in a Survey, other Research Program, other Service and/or use Our Site, a Survey Site, a Panel Site, or a Partner Site in a manner that does not infringe on Our, or a third party’s, intellectual property rights.

9. User Content

You are responsible for all User Content. You are also responsible to obtain, where relevant, third party’s approvals, consents, and/or authorizations for Your and Our use of Your User Content. User Content, including photographs, sound or video recordings may be considered to be Personal Data. Your User Content may become publicly available and shared with third parties including, but not limited to, Our Clients, clients of Our Clients, Survey Owners, Panel Owners, Partners and third party service providers. You shall ensure that User Content does not contain copyrighted or trademarked content or material of any third party, including audio, video, images, or the likeness of anyone other than You, unless You have procured the approvals, consents and/or authorizations from such third parties required for Your and Our use of such User Content. You will not receive compensation for Our, Our Partners’ or Our Clients’ use of any User Content.

By using, uploading, posting, submitting or permitting Us to collect (such permission deemed granted upon Your consent with these Terms and use of the relevant Service) User Content in connection with the Services, You hereby grant to Us a perpetual, irrevocable, unlimited, transferrable, sub-licensable, world-wide, royalty free, right and license to edit, copy, transmit, publish, display, create derivative works of, reproduce, modify, distribute, and otherwise use Your User Content at Our own discretion. You will not receive any compensation for Your User Content or Our use of it, except where expressly agreed.

You are solely responsible to ensure that Your User Content, and Our use of it according to these Terms, will not infringe any third parties’ intellectual property rights. We do not and cannot review all User Content and We accept no liability whatsoever for Your User Content. We have the right, but not an obligation, to delete, remove, or edit Your User Content, which We, at Our sole discretion, deem to: (a) violate these Terms; (b) violate intellectual property rights; or (c) be abusive, defamatory, obscene, or otherwise unacceptable.

10. Policy on Points-Based Incentive Programs

If You respond to and successfully complete a Survey, participate in another Research Program or other Service, You may earn points, which can redeemed for various rewards or cash in Our incentive program. You do not have to purchase anything in order to receive points. The points You have earned are personal and You cannot transfer them to anybody else. Your points will be valid and redeemable for a period of twenty-four (24) months after your account becomes inactive. Any points or incentives not redeemed by You may be revoked by Us.

At the beginning of a Survey, other Research Program or other Service, You will receive information about the number of points that You may earn. We do not accept to be liable or responsible in any manner for tax consequences or duties that may occur as a result of points or incentives issued or redeemed. If You breach the Terms You may lose all the points or incentives which You have earned. We do not accept any liability to You in relation to the points You have earned.

11. Profile Updates

Panel Members agree to keep their membership profiles updated. A Panel Member may update, correct, and/or delete information contained in his or her membership profiles by: (a) accessing his or her Panel membership account; or (b) sending an email to the appropriate Panel Member services team for the relevant Panel.

12. Opt-Out Policy

Panel Members may opt-out from using any or all Services (including, without limitation, from receiving Survey invitations, newsletters or communications) at any time by: (a) following the unsubscribe procedures described on the relevant Panel Site or related sites or contained in an email received from Us; or (b) by sending an email to Our Panel Member services team here

We shall use reasonable efforts, as required by law or regulation, to respond to each email request within a reasonable period of time after receipt. Upon termination of Services, a Panel Member’s contact information will be removed from all communication or contact lists relating to the terminated Service(s). Please note that it may take a few days to complete the removal and during such time, You may receive messages from Us which were created or compiled prior to Your opt-out.

In connection with Your use of the Service, You may be able to link or connect to a Third Party Website. Please note that We do not endorse any Third Party Website or products, services, and/or opportunities advertised, offered, through or in connection with such Third Party Website. Please review all policies and terms applicable to such Third Party Websites carefully.

14. Communications with Us

All communications (excluding Personal Data) and User Content submitted or transmitted by You to Us, by electronic mail or otherwise, or otherwise collected by Us, will be treated as non-confidential and non-proprietary information of Yours, unless You specifically indicate otherwise either prior to, or contemporaneously with, Your submission of or permission to Us to collect such communications and User Content. You agree that any such communications and User Content may be used by Us at Our own discretion.

When applying for Panel membership, using a Service or otherwise communicating with Us or a Panel Owner, Personal Data pertaining to You may be processed. You expressly agree that Your participation in a Survey, other Research Program and use of the Service and browsing of Our site, a Survey Site, a Panel Site or a Partner Site is at Your sole risk and responsibility. To the fullest extent permitted by law, We, Our Clients, Survey Owners, Panel Owners, Partners, or other third parties, and Our and their respective directors, officers, employees, representatives, agents, third-party content providers and licensors, do not make any warranties, express, implied or statutory, including those of merchantability, fitness for a particular purpose, that participation in a Survey or the use of the Service, Our site, a Survey Site, a Panel Site, or a Partner Site will be uninterrupted or error free. To the fullest extent permitted by law, We, Our Clients, Survey Owners, Panel Owners, Partners, or other third parties, and Our and their respective directors, officers, employees, representatives, agents, third-party content providers and licensors, do not make any warranties, express, implied or statutory, including those of merchantability, fitness for a particular purpose, to the accuracy, reliability, or content of any information, or services provided through a Survey or Our site, a Survey Site, a Panel Site, or a Partner Site, other than as expressly set out in these Terms.

17. Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE, SURVEY OWNERS, PANEL OWNERS OR PARTNERS, THIRD PARTIES, OR DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, CONTRACTORS, SUCCESSORS OR ASSIGNEES SHALL NOT BE LIABLE TO YOU IN ANY RESPECT, INCLUDING WITHOUT LIMITATION, FOR ANY MATTER RELATED TO THESE TERMS, THE SERVICE, OUR SITE, A SURVEY, A PANEL SITE, A PARTNER SITE OR FOR ANY SUBMISSIONS YOU MAKE, OR FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, RELIANCE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OF EXPECTED SAVINGS, OR ANY OTHER NON-DIRECT DAMAGES, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE LIKELIHOOD OR POSSIBILITY OF SUCH DAMAGES.

The limitation of liability and the disclaimer in these Terms shall apply regardless of the form of action, whether in contract, warranty, delict, quasi-delict, strict liability, negligence or other tort and shall survive a fundamental breach or breaches or the failure of the essential purpose of contract or the failure of an exclusive remedy.

18. Indemnification

You agree to fully and effectively indemnify, defend, and hold Us, Survey Owners, Panel Owners, and Partners, and other related third parties, including directors, officers, shareholders, employees, representatives, contractors, affiliates, successors or assignees, harmless from and against any and all damages, expenses, liabilities and losses of any kind, including legal fees, arising, whether directly or indirectly, from any breach caused by You of the Terms.

19. Changes

We hereby reserve the right, in Our sole discretion, to make changes to these Terms. We encourage you to review these Terms on an ongoing basis. We will obtain your consent prior to changes that are of such nature that consent is needed or required. For changes that do not require consent, your continued use of, access to and/or participation in the Services does and will constitute your acceptance of these Terms as amended.

20. Compliance with Applicable Law

You acknowledge and agree that You shall at all times comply with Applicable Law when You respond to a Survey, participate in another Research Program or otherwise use the Service.

21. Suspension, Termination and De-Activation

In addition to any and all other available remedies, We may, without notice, suspend and/or terminate Your use of and access to the Service, or Your membership with a Panel, if You are in breach of these Terms or in the event that You use the Service in an unlawful manner or otherwise act in a manner that is, at Our sole discretion, unacceptable to Us, a Survey Owner, Panel Owner, or a Partner. If We terminate Your right to use the Service and/or if Your Panel membership is terminated: (a) You forfeit all rights, title, and interest in and/or to all unredeemed rewards, incentives, and/or prizes, effective upon termination; (b) Your Panel membership will immediately be canceled; (c) Your access to and use of the Service will immediately cease; and (d) You will not be allowed to participate in any future Surveys offered through the Service.

Furthermore, We reserve the right to de-activate Your Panel membership account: (a) if You are no longer an Active Panelist; (b) if We receive a hard bounce or delivery failure notice in Our email communication with Your email account; or (c) if We receive a “mailbox full” reply notice three (3) times in Our email communication to Your email account.

In the event of a deactivation, termination by You, or termination by Us, You forfeit any incentives that You have earned.

22. Severability and Assignment

If, for any reason whatsoever, any term or provision of these Terms is deemed to be void or unenforceable, such term or provision shall be deemed to be severable from the remainder of these Terms, and the remainder of these Terms shall be construed and interpreted without reference to the unenforceable term.

You may not assign these Terms without Our prior written consent, which may be withheld at Our sole discretion. You agree that We may assign these Terms at any time to anyone.

23. Governing Law, Jurisdiction and Legal Venue

Any disputes arising out of or in connection with these Terms, including any questions regarding its existence, validity or termination, shall be referred to Stockholm county court (Sw. Stockholms tingsrätt) and governed by and construed in accordance with the laws of Sweden, without regard to any choice of law principles (whether those of Sweden or any other jurisdiction) that might provide for an application of a different jurisdiction’s laws.

This Privacy Notice defines how Cint AB (“Cint”) uses (collects, stores, uses and discloses and otherwise uses) your Personal Data (“Personal Data” which may also be referred to as Personally Identifiable information or “PII”) and other information described in this Privacy Notice whether you are a member of a panel (“Panel Member”) of a panel owned by one of our Panel Owners (“Panel Owners”) or are a participant (“Participant”) directed to a survey or other market research program by one of our clients (“Clients”) or Partners (“Partners”). Your participation may also be governed by a privacy notice of one of our Panel Owners.

Cint is established in the EU and the information in this Privacy Notice is based on the European Union General Data Protection Regulation (2016/679) or GDPR, which provides a high standard with respect to the protection of Personal Data. However, depending on where you live, other privacy laws and regulations may apply as well. This Privacy Notice applies to residents of every country worldwide.

Cint will, and will cause its affiliates to, establish and maintain business procedures that are consistent with this Privacy Notice.

WHO IS CINT?

Cint provides a global online research and insights platform that connects Panel Owners to market researchers, brands and Panel Members and research Participants for the sharing of consumer opinions and data. Headquartered in Stockholm, Sweden, Cint has offices in major cities across Europe, North America and Asia-Pacific.

Individuals participate in market research on the Cint platform either via membership in a panel of one of our Panel Owners or via one of our Partners who direct Participants to a survey or other market research program. Panel Members and Participants participate in surveys or other market research programs for the opportunity to receive and redeem rewards and incentives for their participation.

Cint’s Panel Owners and Partners who direct participants to surveys or other market research programs are Data Controllers who determine the purposes and means for processing Person Data. Cint will only process your Personal Data acting as a Data Processer, at the request of a Data Controller.

Your Personal Data may be used for a number of purposes that are explained below along with examples of categories of Personal information for each purpose. Specific details on the use of Personal information might also be described further within a survey or other market research program. CINT PROTECTS YOUR PRIVACY

Your participation in a survey or other market research program is completely voluntary and Cint’s use of your Personal Data is carried out with your consent. Surveys and other market research programs administered by Cint’s Clients, Partners or other third parties and the data collected in connection with those surveys and other market research programs are not subject to this Privacy Notice.

Cint is committed to the protection of the privacy of Personal Data. Cint strives to conform its privacy practices to applicable laws, codes, and regulations, and the codes of standards of applicable market and opinion survey research associations, including, without limitation ESOMAR (www.esomar.org) and the Insights Association (www.insightsassociation.org).

HOW IS YOUR PERSONAL DATA COLLECTED?

Your Personal Data will always be collected by fair and lawful means, for specific purposes. For example, Cint may collect your Personal Data when you register for or participate in a panel of one of our Panel Owners, complete a survey, participate in another market research program or via automated means or other methods as described in the “WHAT INFORMATION IS COLLECTED BY AUTOMATED TECHNOLOGIES?” section below.

Cint only collects Personal Data for market research purposes.

WHAT PERSONAL DATA IS COLLECTED AND PROCESSED?

The Personal Data that is processed may include your name, address, telephone number, e-mail address, date of birth, and other similar information. Cint may collect Personal Data directly from you when you voluntarily provide it to Cint or Cint may obtain Personal Data from our Panel Owners, Clients or market research firms who have obtained a Participant’s consent. For Panel Members of a panel of one our Panel Owners, Cint will collect data in accordance with their instructions.

Cint may also obtain Personal Data from database owners who have assured us that their databases comprise only individuals who have consented to be included and have their Personal Data shared. Finally, Cint may collect and use Personal Data obtained from publicly available sources, such as telephone directories.

From time to time Cint may collect Sensitive Personal Data which depending on the country in which you live may include, racial or ethnic origin, health records, financial information, political opinions and religious or philosophical beliefs. If Cint collect your Sensitive Personal Data, Cint will always obtain your explicit consent.

You may also submit, upload or transmit content or material, including photos, videos, and/or any other similar or related content or material which may include your Personal Data, for example, when participating in surveys or other market research programs. Such Personal data may be used and disclosed as described in this Privacy Notice and should not include audio, video, images, or the likeness of anyone other than you.

HOW IS PERSONAL DATA COLLECTED AND PROCESSED?

WHAT INFORMATION IS COLLECTED BY AUTOMATED TECHNOLOGIES?

Cint may collect certain information automatically. Depending on the country in which you live, such information may be considered Personal Data. Such information includes, but is not limited to information about your device and device capabilities including, but without limitation, the device operating system, the other applications on your device, cookie information, IP address, device network provider, device type, time zone, network status, browser type, browser identifier, unique device identification number (such as Identifiers for analytics or advertising), network provider user ID (a number uniquely allocated to you by your network provider), Media Access Control (MAC) address, mobile advertising identifier, location and other information that alone or in combination may be used to uniquely identify your device. A cookie is simply a small text file containing information about the user that is placed by a website on a user’s computer or device. Cint places cookies on your computer or device for survey and other market research program control and fraud prevention purposes.

Cint may also use tracking cookies, tags, and scripts to track certain information about you based on your activity on our site or third party sites. Cint may use this information to determine whether you have seen, clicked on, or otherwise interacted with an online ad or promotion that Cint is working on to help evaluate for one of our research Clients. Subject to your consent, Cint may also select you for a survey or other market research program where cookies will be used to expose you to specific advertising or promotions before the survey or other market research program activity for the evaluation of such specific advertising or promotions.

With your consent, Cint’s Clients or Partners may also place cookies on your computer or device and use those cookies, tags and scripts to track certain information about your activity on certain websites. Cint’s Clients or Partners may use this information for various market research activities.

If you wish, you can choose not to consent to cookies or choose not to accept cookies by adjusting your web browser’s privacy settings to delete cookies upon exiting websites or when you close your browser. You may also configure your browser to block cookies. Mobile Advertising Identifiers:

A mobile advertising identifier is a string of numbers and letters that identifies an individual smartphone or tablet. On iOS, a mobile advertising identifier is called the “Identity For Advertisers” (IDFA, or IFA for short). On Android, the mobile advertising identifier is the GPS ADID (or Google Play Services ID for Android). Cint may collect mobile advertising identifiers or obtain them from a Partner. Cint may use mobile advertising identifiers in our market research programs or to share your data with Clients or Partners. Subject to your consent, Cint may also select you for a survey or other market research program where mobile advertising identifiers will be used to expose you to specific advertising or promotions before the survey or other market research program activity for the evaluation of such specific advertising or promotions.

Cint will only collect or obtain mobile advertising identifiers with your consent.

Web Beacons:

A web beacon (also known as a tag, clear gif or 1×1 pixel) consists of a small string of code that is embedded within a web page or email. They may or may not be a visible graphic image associated with the web beacon, and often the image is designed to blend into the background of a web page or email.

Cint may use web beacons in our email messages to help determine whether our messages are opened and to verify any clicks through to links within the email or in advertising or website research to determine if a Participant has viewed ads or other online content that Cint is measuring. Cint and our authorized agents may link Personal Data to web beacons for operational and research purposes.

Geo-Location Data:

Cint may collect geo-location information from your computer or device. Cint may use your geo-location data for fraud prevention or for market research purposes, including but not limited to advertising research or other tracking-based market research activities. Cint will obtain your consent if Cint collects or uses your geo-location information.

Digital Fingerprinting:

Cint may use digital fingerprinting technology to gather certain data about you and/or your computer or device. This data may include Personal Data such as an IP address, as well as non-Personal Data such as a computer operating system or browser version number. This technology creates a unique computer identifier that may be used for fraud prevention or to identify and track your participation in a survey or other market research program and limit participation in accordance with the requirements of a specific survey or other market research program.

Social Media Information:

You may also be offered the opportunity to participate in surveys and other market research programs through or with social media platforms. If you choose to participate in surveys or other market research programs through or with social media platforms, Cint may, with your consent, collect certain profile information stored in your social media platform account.

Log Files:

Cint automatically gathers and stores certain information during survey and other market research program participation. Our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol (IP) address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser. This information is periodically deleted as part of normal maintenance routines.

Information Cint Collects from Third Parties:

Cint may obtain Personal Data, behavioral and/or demographic information from third parties, including, without limitation, data management platforms, ad networks, information service bureaus, other market research suppliers and/or social media platforms. Cint may use the Personal Data, behavioral and/or demographic data received from these third parties for various purposes, including, but without limitation, data validation, data append, development of marketing insights, fraud detection purposes.

WITH WHO DOES CINT SHARE PERSONAL DATA?

Cint will not make your Personal Data available to any third party without your consent, unless it is required by law, as further specified below.

If a survey or other market research program or other activity includes making Personal Data available to a third party, Cint will only share your Personal Data with your consent. If data collected is used for statistical modeling to better understand trends and preferences amongst specific groups or audiences within the general population, only limited Personal Data shared will be used only for market research purposes and again only with your consent.

Cint may disclose your Personal Data, profiling data, or other research data to third parties as follows:

Cint may license certain limited Personal Data to third parties (e.g., data brokers, data aggregators, etc.) for market research purposes, including, but without limitation, the licensing of individual-level and/or aggregated-level data (e.g., product and/or service purchasing or usage activity, website visitation data, internet search history, etc.) for the development of audience insights and/or look-alike models, for the purpose of sale of such data to the third party’s customers for the purpose of performing analytics and providing marketing intelligence. This information may be shared via a cookie (cookie ID), a mobile advertising identifier, an email address or other method. After look-alike modeling or aggregation have been performed, Personal Data is deleted.

Additionally, identifying information and information collected by automated means may be provided to third parties, including, without limitation, Clients, Partners, agents and/or vendors for the purposes of identifying respondents for re-contact surveys or communications, fraud detection and/or prevention, database matching, data validation, data append, coding, data segmentation, and reward, incentive, and/or sweepstakes or promotion related services.

Cint may maintain Personal Data or machine identifiable information in order to satisfy your requests and/or Cint’s business requirements. For instance, Cint may retain the email address of Participants who opted out to ensure Cint conform to any such wish. Any retention of Personal Data is done in compliance with applicable laws and regulations.

Again, Cint will only share your personal data with your consent.

DOES CINT COLLECT INFORMATION FROM CHILDREN?

Cint does not knowingly collect Personal Data from children below the age where parental consent is required. If Cint becomes aware that Cint has inadvertently collected Personal Data from a child below the age where parental consent is required, Cint will delete such Personal Data from our database.

WHAT SAFEGUARDS HAS CINT IMPLEMENTED TO HELP ENSURE THE SECURITY OF YOUR PERSONAL DATA?

The security of your Personal Data is very important to us. Accordingly, Cint has put in place reasonable technical, physical, and administrative safeguards to protect the information Cint collects. Only those employees who need access to your information in order to perform their duties are authorized to have access to your Personal Data.

Despite the safeguards Cint implements, transmissions over the Internet and/or a mobile network are not totally secure and Cint does not guarantee the security of online transmissions. Cint is not responsible for any errors by individuals in submitting Personal Data to Cint.

RETENTION OF PERSONAL DATA

Cint will store Personal Data no longer than necessary for the purpose of the processing activity or as authorized by you. This period may also be based on Cint’s or one of our Panel Owner’s or Partner’s contractual commitments to you, applicable periods of limitation (to bring claims) or according to applicable law.

You have the right to review, correct, or delete your Personal Data, subject to applicable laws and regulations. Specifically:

Upon receiving a request from an individual, Cint will attempt to provide the requested information within 30 days, providing that the request is such that it can be reasonably be responded to in that time frame. If more time is required, Cint will notify you within thirty days.

HOW DO I OPT-OUT?

You may choose whether or not to participate in a particular survey or other market research program, refuse to answer certain questions or discontinue participation at any time. However, failure to provide certain information or fully participate in a particular survey may preclude you from receiving incentive compensation or participation in future certain research studies. Panel Members of a panel of one of our Panel Owners that no longer want to participate in surveys, other market research programs or be subject to the use of automated technologies or other activities, including cookies, can opt-out by visiting the Privacy Settings page of the member portal for the panel you belong. The Privacy Settings page can also be reached by clicking on the opt-out links on survey invitations. TRANSBORDER POLICY

Cint stores data in the European Union (EU) and the European Economic Area (EEA). However as a global organization, a Cint affiliated company or non-affiliated service provider may collect, process, store or transfer your Personal Data outside your originating country.

The (EU) and the European Economic Area (EEA):

Cint’s legal entities outside the EU and EEA have entered into intra-company data protection agreements using standard contractual clauses prepared by the European Commission. Cint has contracts in place with service providers and other business providers that require the contracting parties to respect the confidentiality of your Personal Data and to handle European Personal Data in accordance with applicable European data protection laws.

Russian Federation:

In accordance with data protection laws of the Russian Federation, Cint collects, processes and stores Personal Data of citizens of the Russian Federation in the Russian Federation and only subsequently transfers that data to the EU or the EEA.

LINKS TO THIRD PARTY WEBSITES

This Privacy Notice applies solely to our surveys and other market research programs, and not to any other product or service. Our surveys or other market research programs may contain links to a number of third party websites that Cint believes may offer useful information.
